Membership Account Terms and Conditions
Hornby Hobbies Limited, a company registered in England and Wales with registered number 2065081 and with its registered office at Hornby Hobbies Limited, Third Floor, The Gateway, Innovation Way, Discovery Park. Sandwich. Kent. CT13 9FF ("Hornby Hobbies") operates the "THE COLLECTOR Membership Account" (Membership Account), which lets you log in to the www.hornby.com website (the "Site") and use additional services offered by Hornby Hobbies as and when relevant.
These Terms and Conditions will govern any use you make of The Membership Account and associated services. We reserve the right to update the Terms and Conditions at any time. When we do so, we will provide access to the new Terms and Conditions here and provide you a message through your membership account. The new Terms and Conditions will take effect immediately.
By registering for a Membership Account, logging in to your Membership Account or otherwise using a Membership Account or one of the Services, you agree to comply with these terms and conditions.
Using your Membership Account
Your Membership Account makes it easier for you to use and place orders on the Site and to use the Services.
We do not guarantee that your Membership Account, the Site, or any of the Services, will always be available or be uninterrupted. Access to the Membership Account is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Membership Account without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.
Creating and logging into your Membership Account
When setting up your Membership Account, we will ask you to provide information about yourself including payment information and card details. You must make sure that any information you give to us is accurate.
Each membership account requires a unique email address.
It is your responsibility to keep the login details secure. If anyone logs in to your Membership Account using the correct credentials, we are entitled to treat them as if they are you or are authorised by you to use your account. We will never ask you for your login details outside of the login process itself.
You will receive your welcome letter, Membership Card and THE COLLECTOR club badge within 28 days of signing up.
Your FREE Loco will be supplied seperately when stock becomes available.
You will need to ensure that the personal details you have recorded with us are accurate and up to date.
Please note that we reserve the right to suspend or terminate your account if it is or appears to us to be used in breach of any of the provisions of these Terms and Conditions, including the provision of false registration details or any other misuse of the Site. Any person who holds such a suspended or terminated account must not re-register on the Site without Our prior consent.
Other terms that form part of the contract
Security and Passwords
When you create a Membership Account you will choose a user identification code and password. You must treat them as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We will never ask you for your login details outside of the login process itself.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at email@example.com
We reserve the right to delete or deactivate any Membership Accounts that we regard as being inactive due to not having been used for a reasonable period of time. If we do this you may not be able to continue to use the Services and will have to create a new Membership Account in order to use the Site and the Services.
Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in the Membership Account, the Site, and the Services. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.You must not modify or attempt to modify the Membership Account, the Site or the Services, nor to compromise any of the security features associated with the same. Our status (and that of any identified contributors) as the authors and owners of the Membership Account, the Site and the Services must always be acknowledged.You must not use any part of the Membership Account, the Site and the Services for commercial purposes without obtaining a licence to do so from us or our licensors.
THE COLLECTOR is a private members club for consumers only. The Membership Account, the Site and the Services are for domestic and private use only.
By signing up and becoming a member, accessing Membership Account, the site or the Services, you agree not to use Membership Account, the Site or the Services for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
If we feel an account is being used commercially, and/or if Hornby Hobbies reasonably believes that an Account Holder is in breach of these Terms and Conditions or that the Account Holder has abused the THE COLLECTOR club, Hornby Hobbies reserves the right to take any appropriate action, including suspending or terminating the Account Holder's Membership Account with immediate affect..
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Membership Account, the Site or the Services.
We assume no responsibility for the content of websites linked on the Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them. Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods by use to you, which will be set out in our Terms and conditions of supply.
No party other than the Account Holder and Hornby Hobbies has any rights under the Contracts (Rights of Third Parties) Act 1999 or any equivalent legislation in any jurisdiction, or otherwise, to enforce any term of these Terms and Conditions. These Terms and Conditions are subject to and shall be interpreted under English Law.
In relation to your personal data, Hornby Hobbies Limited is the data controller. We will share your personal information with our Fulfilment partners UKMail & PCS for the sole purposes of administering Collector Club communications on behalf of Hornby Hobbies Limited.
